The KR Tribunal: Catch-22 plus the mysterious Cases 003 and 004

Perhaps this exchange of views on Khmer Rouge Tribunal coverage is becoming just a little too philosophical!

OK, in a few decades, when the world population reaches 9 billion, there will be horrendous wars over water resources, if Armageddon hasn't come before then iin dire scenarios now being postulated by certain Old Hacks from Down Under.

Catch-22 and mysterious other cases::

There's a Catch-22 aspect, too. The trials are being jointly held by the current regime that is itself composed of other Khmer Rouge, and it is a joint venture with the United Nations; in other words it's a hybrid court.

These other Khmer Rouge were the ones who fled to communist Vietnam to escape internecine warfare among the Pol Pot-led Khmer Rouge in the waning days of Democratic Kampuchea. They were placed in power when Vietnam invaded Cambodia in late 1978 and overthrew the Pol Pot regime.

They didn't run to Vietnam because they were freedom-loving democrats, but to save their skins. Now they are all very wealthy politicos, whose offspring drive the civilian Hummers and other behomoths that help clog the once charming streets of Phnom Penh.

Today in Cambodia, where television is an important medium, almost all the channels are controlled by prime minister Hun Sen's Cambodian People's Party (CPP), the former communist party, which will, as a result, again more than likely win next year's election - a majority of the potential electorate are too frightened to vote any other way.

There's also controversy now over the somewhat mysterious 'Cases 003' and 'OO4' which are to be heard, some foreign lawyers hope, two or two and a half years from now when the current case 002 is hopefully completed against the surviving Khmer Rouge policy-making leaders in the dock this past week.

Case 003 is about the Khmer Rouge naval and air force commanders who had Killing Fields operations and camps of their own in which thousands allegedly died. Case 004 concerns three other Khmer Rouge mid or high level cadres who allegedly may have caused many thousands of deaths.

Some of these foreign lawyers say now that unless these other Khmer Rouge figures, who were perhaps more apparatchiks and not policy-making leaders, are investigated, justice will not have been seen to be done at this tribunal. The Cambodians will not have found closure, as the over-used expression has it.

But Hun Sen, who likes to be called 'the strongman,' has warned there will be no other trials or indictments beyond the current five former leaders. He fears, he says, that this could lead to civil war.

Many former Khmer Rouge live side by side with ordinary folks in the villages and there are some KR enclaves such as Samlaut in north western Cambodia.

What he is really afraid of, foreign lawyers say, is that the court's tentacles will spread closer to his regime, or to other former Khmer Rouge who enjoy the protection of the regime. The three top leaders of it are pictured on roadside boards all over the country - all three are former Khmer Rouge, and what is known of their part in the Cambodian tragedy?.None of them will appear in court to give evidence and be questioned.

Lawyers with certain NGOs think that, without further indictments, the whole KR Tribunal will have been compromised, that justice will not have been seen to be done for the still suffering Cambodian population. But there are hints that, if this is pursued, even the current case 002 will come to grief, as the present regime may attempt to abort it.

But other foreign jurists believe if the current trials end successfully then justice will be done and it will be futile to hold further trials. (I have to admit I've tended towards this myself because, after all, they are the leaders who created the Khmer Rouge and its policies; also, where are future funds to come from? The tribunal, which started in 2006, has already cost US$150 million). And there will be probable trial fatigue by that time anyway.

The matter on hand:

From the replies received on why so few big newspapers or tv channels or agencies were represented, we can see that part of the blame lies with the fact that, in the past, the tribunal has been mired in procedural matters, except for the case 001 trial of Duch, the S.21 torture centre boss, who is now serving a 19 year sentence, incidentally in the same rather small holding centre in the court's grounds (the army's HQ). Most foreign hacks didn't expect a suddenly revitalised tribunal.

In the past, often a tribunal event has been adjourned just hours after beginning.

Perhaps, also, the tribunal media office did not publicise the current trial which started last Monday with enough wide-ranging thoroughness.

A second reason, as we heard from Denis Gray, is the unavailability of funds in sections of the Western media, given the alternative internet news outlets we have today. The world economic situation doubtless also kicked in.

In all the circumstances, the stringers did a good job, though they didn't have the influence that staffers would have with head office..

It should also be mentioned that the young foreigners and Khmer journalists who work for the two English language papers here, The Cambodia Daily' and the 'Phnom Penh Post.' do an excellent job of reporting the reality of Cambodia today, the land-grabbing,favoritism, corruption, political chcanery, criminality and the rest.

The slain soldier's father, Dr. John H. Johnson, didn't buy the official story from the start.

Apart from the excellent Seth Mydans of the NYTimes/IHTrib, and the late arriving Michael Sheridan of the London Sunday Times, most international media seemed to miss the opening of the Khmer Rouge Tribunal on Monday this past week for its first ever really substantive session.. Local stringers did most of the work, including for the agencies. The BBC had a reporter doing a featurish piece, but CNN were unsighted, and I didn't see any US channels..


But this was a story that should have been attended by the Washington Post, LA Times, Guardian, the Times of London, Daily Telegraph etc., plus topline television.


It was only by luck that I was there. I was coming to Cambodia anyway for personal reasons, but I coincided my visit with the trial though, in truth, I did not expect much; I anticipated it might adjourn after a couple of hours. I didn't expect dramatic stories.


But it turned out to be an incredible three days. Becaue I did not have a firm assignment, I sat in the courtroom upstairs while most of the small band of reporters were downstairs in a court ante-room so that they could monitor television and get their stories off quickly. I had a ringside view, more by luck than any clever thinking of mine beforehand.


After years of seeming near irrelevance, except for the trial of the Khmer Rouge apparatchik Brother Duch in mid-year, the court suddenly blasted alive.


The two opening hours-long statements by the Cambodian and foreign co-prosecutors, Mde Chea Leang and Andrew Cayley. were - well, I can only say powerful, brilliant and, as I said yesterday, extremely harrowing. The presiding judge, Nil Nonn, with a law degree from Ho Chi Minh university, took a firm grip on proceedings - he has obviously grown very much in the job.


The appearance in court of the surviving three Khmer Rouge leaders, those who made policy, was one of considerable drama. And although Ieng Sary, 86 and Nuon Chea, 85, appeared very frail, their voices were strong and firm, as was Khieu Samphan's, the one leader, age 80, who could walk under his own steam.. There was no sign of senility in any of them (and I don't really believe that Ieng Thirit, the 'first lady' of the Khmer Rouge regime, is really senile, only doped up). Khieu Samphan gave evidence of great intellectual capacity (although personally I have always found him cold and unfriendly).


But have we now entered an age where events of world importance can no longer be adequately covered because of inadequate budgets? I am afraid that this is the case although i would rather believe there was low expectation over what the tribunal could produce. If it is now the case that proper coverage of a stellar event can't be paid for, we are all in deep trouble.


When the court reoconvenes on 5th December for the first witnesses to be heard, I hope there are throngs of journalists in position. (It would be interesting of hear the views of the Old Hacks).

America and their Cambodian reporters have been broadcasting great
news not only of the tribunal but Cambodia news in general. So much so
that Hun Sen is unhappy. Intriguing how what we often thought of as a
cold war relic has become a primary source of news for Cambodia in the
21st Century. You all know Dan. Chris is a fluent Khmer speaker who
worked at the Cambodia Daily (and hired Thet Sambeth who later
reported and produced the acclaimed 'Enemies of the People"). The
chairman of the broadcasting system is Walter Isaacson, whose book
Steve Jobs is at the top of the best sellers list. He is a great
defender of the enterprise which he is pushing towards the BBC
model.

Maybe YOURS did but mine were in Eastern Europe. Don't know much about them but did find out that my great grandmother was shot while some Nazi tried to redistribute her house and made her "occupy the woods". Had the grandparents not relocated to the U.S. before all the fun began, I may not be here, writing on this blog.

Mine were mostly scandinavian, Swedish and Danish. With some German thrown in.
But, the point being that it was the WHITE man that made this country multi-racial.
